  • HELP!! I filed an I-485 several years too soon.

    My brother submitted an I-130 for me, upon receiving the approval I applied for an I-485 (because I was ill advised) my priority date was NOT current but I did receive an EAD which has expired. Now 18 years later, my priority date is finally current and I am ready to apply for my I-485. Will there be issues because I had applied before? Do I need to do anything to have the previous I-485 removed/deleted before I send the new one. I need HELP!!!

    A premature I-485 should have resulted in a denial or a rejection of the I-485 package and return of your fee check and paperwork. Did you ever get notification of such a denial or package rejection?

    Either way, you were not eligible then, and if your Prority Date is now current, you should be submitting a new I-485 fee and package.

      I never got my money back and haven't heard of a denial. My EAD expired and I never reapplied. I was just anxious thinking I may have to make a motion to have the previous one deleted/removed from my record.

        How long ago was it submitted? If you actually received an EAD as part of the submittal fee, and that inclusion only started about 6 years ago, they did cash your check. But it's hard to understand why you never received a status report on the I-485 processing.

          The whole process was done back in 1998. I don't recall ever hearing back. They did cash my check and i don't remember what happened next. I just don't want that to hurt my chances of being able to adjust my status now.
