  • I-130, I-131, I-765 processing times when I-485 RFE received marriage-based AOS

    Hi there,

First of all thanks to everyone who posts on here - the information on the forum is amazing and really helped with the application process. My question relates to the processing time for I-130, I-131 and I-765 when the I-485 process is delayed by an RFE. Our timeline is below.

    2 January 2015 - Got married (yay!)
14 February 2015 - Sent joint application for I-485, I-130, I-131, I-765 for AOS from G-4 visa status (this also means some extra forms although my G-4 status ended in February)
17-20 February 2015 - acknowledgement of receipt of all 4 applications, checks cashed, case goes to MSC
12 March 2015 - fingerprints taken as scheduled (Manhattan NY)
17 March 2015 - RFE received, as expected they wanted my husband's 2014 taxes and supporting docs, which he didn't have until April. We also sent proof of my assets, justification for me not filing taxes (as a G-4 visa holder you don't even though I have been here for years) and a new I-864 because the original was now incorrect
27 April 2015 - MSC acknowledge receipt of response to RFE, update says decision/further update by 26 June 2015

My question really is whether the I-131, I-130 and I-765 will also be decided by 26 June or does the clock for these start counting for 90 days from 27 April? I understand everything is on hold during the RFE (they stopped working on the case on 9 March and just started again) but the only case that updates is the I-485 so I'm a little bit confused as to how they relate.

Just trying to get a sense of whether this means the application besides the I-864 was fine and I can hope for the EAD/AP sooner rather than later - I am living off savings and need a job and also to travel back to Europe in the next few months. I'm a UK citizen, by husband is a US citizen by birth.

Thanks for any insights you might have!

Yes, you case does start over from the day they receive your RFE, (April 27), but I doubt it will take exactly 90 days, from that date. It will take less. Good luck!!
