  • Request for initial evidence I-864 Help!

    I got an yellow RFE letter on the mail about the affidavit of support and it got me kinda confused.
    The poverty guidelines say for a family of 2 the annual min income is around $19000... well my husband make 41000 annual and the rfe say we do not meet the poverty guidelines and asked for a joint sponsor.
    Do we really need a joint sponsor? It's only the both of us, we don't have kids yet, so I thought his income would be enough.
    I sent his w2 and tax return. He is still single on the tax return, but can't see it as the issue...
    If anyone can help us will be much appreciated.

    I had the same issue. Originally i only sent the transcript i printed off the IRS website. but when i got the RFE i was confuse cos its only 2 of us and i make over 32k. I sent my w2s and tax return in along with my sister as a joint sponsor. Hopefully that would be enough!

      It's crazy! And I am still very confused because I still don't know if I really need a sponsor or not. Hope someone can help me with that answer... Considering that my husband makes over the min guidelines this letter made no sense to me.

        Something must be wrong, for a RFE to be sent to you,..
        I would suggest you do the following:-

        Get a Joint Sponsor, that can cover the amount

        To be on the safe side, still send in your husband's 2014 RIS, Certified Tax Returns. Get this directly from their website.
        His job letter, stating, when he started working, his annual salary and the rate he receives. This must be on job's letterhead
        He should also get six month's pay stubs from his job.

              It is Crazy, its just ridiculous the unnecessary things these people ask for. Like i was saying, i was just in the same boat and it was frustrated me. But i sent back my W2s along with my sister as a joint sponsor. They just received my RFE so i'm keeping my fingers crossed that they don't asked for anything else. I did not want to get an attorney bc i couldn't afford it but if you can afford it hey get one.

                We all mean to be helpful to your situation with our responses, understand that. Us on the outside don't know what USCIS officers are seeing and using when they go through our forms, we only have the guidelines provided by their website....unless we work directly with the agency.
                Wouldn't it be easier to get a joint sponsor and cooperate with their request, rather than get a lawyer or something along that line? I would go with MaryH's suggestion and follow it to the t like she stated.
                The very same thing reached me when I thought all my bases were covered and that our income superseded what they needed, but I guess they looked at other factors. As soon as I submitted the joint sponsor info, they started working on my case again. Now my EAD and travel card are approved and we are just awaiting our interview.

                It's a long and sometimes frustrating process, but it's very doable.

                I meant also to say that USCIS has the final say so
