    Hello, in May 4, USCIS ACCEPTED the I-485 and today May 20 the status updates saying that "on May 20, 2015, we suspended processing of your case, because we need more information from you. Your notice explains what we need from you to resume work on your case. We will not take action on your case until we receive the evidence or the deadline to submit it expires.


    I am a little worried because I don't know the reason why they need evidence. I did submit the correct documentation and properly signed the forms.

    Anyone has a idea what kind of evidence they are asking for?

    What are the possible reasons that they are asking for initial evidence?
    My husband came in the U.S. With the K-1 fiancé visa,
    1: entered the United States January 31, 2015
    2: married in February 18, 2015
    3: I-94 expired in April 28, 2015
    4: USCIS Accepted -765 and I-485 in MAy 4, 2015.
    5: May 20th, 2015 USCIS NOTIFIED us that they need initial evidence.

      Your RFE might be something just simple, that you may have over looked. No one can say for sure what it could be.
      However, be positive, and don't work up a sweat when there's reason to. You will be fine.

            Hello, today we received a letter for the biometric oppointment scheduled on June 5, 2015. I think on Tuesday the letter for initial evidence will arrive.

              Hi Mary H,

              04/02/2015 : USCIS received my I-485 package (my I-130 already got approved on 01/14/2015)
              05/04/2015 : Biometrics
              05/04/2015 : Received letter for RFE
              05/20/2015 : USCIS review my RFE letter

              1) RFE said my husband income is not enough for 2 person household, but his make $30000 a year, from the chart (I-864p guidelines) it should be enough right?
              And they ask for Bank Statement for past 12 months (when we send the package, we dont include bank statement)
              So we send the bank statement, and we have $20000 in our account, is that enough?
              Because we dont have any joint sponsor.

              2) is that right we will receive EAD at least 90days from the day USCIS received our package?

                Hi Mary, I realized that I send the a copy of my birth certificate where I was born in Mexico. It had to be translated?

                    The poverty guidelines is $15,930. Seems like the figures gall this year. I don't know what was sent wrong or not sent, since u said, the wages is $30,000.

                    Yes, you should get that birth certificate translated.

                      Hi Mary, I did receive the letter from the USCIS for the initial evidence. It says the following:
                      1: the petitioner sponsor on form I-864 affidavit of support must submit a complete federal income tax return submitted to the IrS for the most recent year. If you weren't required to file please submit a written explanation of why you are not required to file.



                      My situation for this was as follows:

                      During year 2010 to December 2014 y went to university and graduated. I didnt work at all all those year. This year I started working and submitted the form I-864 with my 8 recent pay stubs but don't have income tax return from previous years as I explained my situation.

                      With all my forms I also submitted a co-sponsor because I knew I wouldn't qualify myself since I didn't work previous years.

                      Can you ease Mary tell me what to do? With the written explanation should be enough? How should I write the explanation, in what format?



                      2: submit an English translation of the foreign language birth certificate.

                        Your explanation can be validated, and will be accepted. You could state the Name, Place and Address of the School you attended; along with that you could send some evidence for all the years you were in school. Test result anything....

                        It's also, smart of you to send your current pay stubs. You could give a little information on your current job, such as when you started or anything else that's not on the pay stubs.
                        Yes, you did the right thing in getting a Joint Sponsor.

                        In the topic of your Birthday Certificate, I'm not able to do your translation, if someone on this forum would be kind enough to translate it for you or advise you where to have it Translated, that would be great. Good luck!!

                              One quick question Mary, can my partner get a temporary Texas ID card ? He is currently a K-1 fiancé visa holder. Remember that his I-485 and I-765 are pending.
