OnH1B and filing I-485 (Adjustment of status) with I-130 through spouse citizenship

  • OnH1B and filing I-485 (Adjustment of status) with I-130 through spouse citizenship

    Currently I m on H1B and filing for I-485 along with I- 130 as my spouse is a citizen. My entry last time in USA was on student visa F-1 that was issued in India.
    What information do put in for questions:
    1.Non-immigrant visa number ?
    2.Consulate visa was issued?
    3.Date Visa issued
    Whether F1 visa number (F1 Visa has already expired) or H1B (Working on Approved H1B in 2013 and is not yet stamped) . This question is confusing for me.

      Technically, you're on H1B status but you don't have H1 visa on passport. You have 2 options :
      1. Consult / File using Immigration lawyer (always preferable to avoid rejection on petition due to improper filing)
      2. Visit India and go through H1B stamping, re-enter US on valid H1B visa stamped in passport.

      First option is always preferable - expect 2000-3000$ for Immigration Lawyer to charge you for filing petition & avoid delays plus peace of mind if you have any questions until you receive GC. You'll need additional USCIS petition fees ($1490 for concurrent filing).

        Hi Amit, I am on the same boat. Entered US with F1 Visa and I am now on a H1-B. Married to a US Citizen and filing I-148 and I-130 concurrently. I am confused on how to answer the questions about Visa details. Hoping you found the answers and could help me.
