  • DUI & Applying for 485 - Need Answers for specific Q?

    Dear Members,
    I have been convicted of DUI three years back. All fines, court charges, restitution charges and one day in Jail is completed.
    Everything is clean now. I'm filing 485. While filing 485, i stumbled on these Q?'s where i don't have a definite answer.

    Q 1 . Section 15, option b says - Have you served in any jail, prison, prison camp, detention facility, labor camp, or any other situation that involves detaining persons.
    I answered yes to it. Since i served one day in jail. I just wanted to make sure that it is "yes" in my case?

    Q2. I also answered "YES" for option 1, b which says "Been arrested, cited, charged, indicted, convicted, fined, prisoned, for breaking , violating any law or ordinance excluding traffic violations. I hope the option "YES" is correct. I know it is silly to ask this Q? but just wanted to ensure.

    Q3. Page 3 of initial evidence section of I485 instruction, it says to submit some documents.
    What i understand is, i need to submit:
    Court Certified Copies,
    Court Disposition Letter
    Completion of all rehab programs sentenced by court and fines and charges being paid.

    Do i need to submit all these copies in ORIGINAL? Even the completion certificates of all programs like MADD, TSS etc in original ?

    Q4. What is the difference between court certified copy and court disposition letter?

    Q5 Do i need to submit police clearance certificate also?

    Your answers will help me a lot. Please enlighten.

    I assume this all happened here in the US.

    Q1 Yes, "yes".
    Q2 Yes, "yes".
    Q3 Certified copies of arrest record, certified copies of court disposition. Contact the arresting agency and the court. I don't know this for sure, but I imagine the court disposition will incorporate information about your sentencing/rehab requirements; I am certain it includes information about fines paid. The agency/court will charge you a nominal fee for issuing certified copies.
    Q5 We don't have that concept here. They will get all your criminal records as part of the AOS process.

      Yes all happened in US.
      I have the court disposition letter, which is the one where the emblem or seal is raised.
      Certified Copy of Arrest means ? - Do i need to get from police department? If yes, do i need send them the original.

      Do i need to send the originals for the programs i completed as part of rehab?

        Doesn't your court disposition already say you have completed all the terms of your sentence?
        Yes, get the document from the police department that arrested you. A certified copy will have some kind of seal or emblem, just like the court document.

        "Certified copy" means issued from the agency.

          It says the date of Jail attened. But doesn't specifically says it is completed. I will go to court to get fresh one. This certified document i have is 3 years old.
          I think i will get the latest one and submit.

            Dear Inadmissable and Other senior members(who have gone through this phase)
            Please read below my further Q?'s and help me in answering this.

            Point 1.
            I called up the police department and checked, if they can give me a certified copies of arrest records.
            They said, they don't issue any certified copies of arrest records.
            They can issue a letter for all arrest details which normally takes 8-10 weeks.
            And i don't have 10 weeks of wait time to submit 485 application.

            Point 2.
            When i read about the Criminal history documents that needs to be furnished for 485 filing on the instruction page of 485 :

            It says i need to submit:

            1. An Original or court certified copy of the sentencing record for each incident; and

            2. Evidence that you completed your sentence, specifically
            a. An Original or certified copy of your probation or parole record; OR

            b. Evidence that you completed an alternative sentencing program or rehabilitative program

            The point is there is no WORD saying certified copies of arrest records.
            The point 1 points to court disposition letter, which i can get for sure.
            The point 2 B points to all MADD, TSS, Other things, i have completed, and i have that too.

            Point 2A is not applicable to me. Since i had no parole OR probation. But i had to serve one day Jail alone.

            Am i good in submitting point 1(Court disposition) and Point 2B ( MADD, TSS, and other documents).
