  • I-130 and I-485 Questions

    Good night people

    i have some question i am a US citizen and i want to bring my wife from Mexico, she has legal paper B-2 Visitor visa with I-94 Form to be in the United States.

    i want to get her green card, i have gotten some information on what paper i need

    I-130

    I-485

    supportive Documentation - copy of passport, copy I94, copy of US passport,
    i read that i need to send 2 G-325A one from me and for my wife
    Copy of Marriage certificate
    color picture of myself and 2 of alien, passport size

    I-864 plus 3 years of income taxes and W-2 forms

    I-693 Medical Examination by certified civil surgeon sealed envelope

    this is what i have read and well of course the payment for all of this forms
    i need help as in if i need any more forms and if i have to mail them or drop them at the office

    i live in Imperial Valley there is a office here locally.

    Any help would be great

    All the paperwork you are describing generally meets the requirements for petitioning and adjusting your wife's status. But a couple of things you mentioned need to be clarified:

    1 Have another person, who has experience with this type of processing review your paperwork before submitting.
    2. You cannot just drop the package off at a USCIS office. You must mail it to the Chicago USICS "dropbox," at:

    PO Box 805887
    Chicago, IL 60680-4120

      Gustavo - Since you're US citizen, your wife (alien) is eligible for concurrent filing petition. You can file I-130(alien petition), I-485(adjustment of status), I-131 (Advance Parole travel document - incase she need to visit Mexico), I-765 (work authorization for wife - EAD card).

      Other forms like I-131 & I-765 is free of cost if you file them along with I-130 & I-485. Make sure you attach 2 different check :
      1. Check in the amount of US$420 for I-130
      2. Check in the amount of US$1,070 for I-485

      USCIS declines application if you send single check for total $1490.

      Concurrent Filing address :

      USCIS
      Attention : I-485 Form
      P.O. Box 805887
      Chicago, IL 60680-4120

        Thank you again for the help, i had planned on taking all the documents to a immigration lawyer or similar to make sure they are filled right. i just wanted to make sure i was going to use the right forms also do i have to submit all the forms at the same time or just initially the I130 and the I485

            i just want to make sure since i am almost ready to submit all the forms, do i need to submit 2 G-325a, one for myself and one for my wife. or do i submit one just for her.

              Gustavo,

              The I-130 for a spouse should also include a G-325A for both spouse and petitioner.
              The I-485 needs only a G-325A for the beneficiary.

                so how would it work if i am going to submit both of them, the I130 and the I485 i would submit 2 with the I130 and another one for my wife with the I485

                  You will be filing the forms concurrently. You need one biographic form for each of you.

                    I'll clarify what I emailed you earlier:

                    Your I-130 should have a G-325A for you and your spouse.
                    Your I-485 needs only a G-325A for the Adjustment applicant.

                      Can I Apply I485 after I130 is received?

                      Hi RayB,

                      I was going through this thread, I hope it is relevant to me as well.

                      my Wife has already filed I130 and now I came across about I485 that we are eligible to file that. But, question can I now apply for B2 visa and my wife apply for I485 once I am in US?
                      She is US citizen by birth.

                      Please help!

                        If you are allowed entry on a B2 visa, you can proceed with I-485 processing.

                        But if the Immigration officer decides that you are using the B2 visa to continue with Permanent Resident processing, he can bar entry.

                          Hi Ray B,

                          Yes, I went through threads and online articles. I won't be allowed to enter now. So, only thing is I have to wait for my visa.
                          Is there any chance if I can get job offer and then travel?

                          I am also waiting for K3 visa, my wife already applied for it and the status says it is in another office and that office has jurisdiction over my case.

                            If you have an existing I-130 in process, a K3 visa request will not reach the NVC or Embassy for K3 processing. K3 visas are not being actively supported by USCIS anymore.
