After marrying a EU citizen in the US, can I just process the I-130 form and expect an answer within a year on the via issuance?

You can file both 130/485 concurrently if you are in US and have a legal status.

you can file the 1-130 and 1-485 together even if you're out of status...so long as you were inspected (came through airport/port and saw an immigration officer) when you first entered the US
