    Hi,

    I will be filing for a family based green card around 2nd week of July after my marriage to my wife who is a US citizen. It is extremely critical for me to file for AOS by July 2nd week because my current H1 status expires on 10/16/15.

    My question is regarding form I-864. She has not filed her taxes in last 2 years and she may not be able to before 2nd week of July.
    She would not be able to show her 1040 tax returns that is needed in I-864.

    However, my brother who has a green card and his taxes are paid to date, wants to find out if he can sponsor me. Can he do so?

    If so, what form should he fill I-864 or I-864A. He does not live with me.

    Sanchit,

    Your brother should submit form I-864 with supporting documents.

    Your wife will need to include a statement, signed and dated, explaining why she has not filed income tax returns.
