  • Widow while case still pending

    Hello everybody,

    Please I need your advice,I lost my younger brother to a car accident 2 months ago,but before he died he filedI-130,I-1485 etc in March for his wife and it is still pending,so I want to know what happens to her case,does she have to leave the U.S.?I am worried and concerned about her?

    i don't think she has to leave but i do believe someone else can become the petitioner.You should consult a lawyer for some advice or call uscis.Condolences to you and the family

          The wife can self-petition, using form I-360 and sponsorship will not be needed because of her widow status.

          Her I-130 might even be converted to I-360 status, but I would verify this before assuming the conversion.

          An attorney is not needed to accomplish the self-process, as the rules are very clear for immigrant widows of U.S. citizens.
