  • re filing I -485 after NTA removed

    Hello,

I have filed for my spouse I-130 and I-485 almost two years ago, until we found out that we need to close out old removal proceedings that was administratively closed (never went to court). I-130 was approved and after long period of time we finally got NTA cancelled without the court hearing. Now we need to refile I-485 with USCIS to adjust status, however I have many questions...
Other than paying a fee all over again, do I need to file all other original documents as well, such as doctors exam, certified copies, etc? ( although it is in immigration file) Do i need to file spousal support? Also, how do I properly document removal proceedings closure in the application? Anyone had experience with this? We now live in a different state, so although I knew there was an option to re open administratively closed I-485 case, we figured it will be much faster process to file new application.

    Thank you

You are correct that it is quicker to file a new adjustment application from scratch. You will have to provide all the supporting documentation needed.

Thank you, do you know by any chance what is the difference time wise re opening application and filing for new I-485? In other words, if we file new, I know it may take up to 6 month to get a green card, but how long does it take to reopen old case?

        Hi Betty Last,

I was wondering did you ever receive NTA in the first place? When removal proceedings started? Exactly how was your timeline? What happened when they started the removal proceedings?
My wife is in the similar situation and we recently filed. Almost 2 things, proceedings and filing coincided for us. I want to make sure that the proceedings are administratively closed to avoid further delay.

        Thanks.

MTR takes a minimum of 18 months, usually 24 months
