  • I-485 from Visa waiver

I am hoping you can help.

I came to the US to visit my BF and we decided on this latest trip to to get married.

We are now applying for an AOS.

Should we include a letter of explanation, detailing the progression of our relationship and how we came to this decision? Or is this something that we should address verbally in the interview?

Our only concern is demonstrating that there was no intent on entry to adjust - I came in as a visitor on the VWP and had every intention of going back home. We'd never talked about the possibility of getting married before, so there definitely was no intent!

I am a contractor so work on a project by project basis, so there is no current employer to vouch for my intended return home... I also don't rent my own place, I stay with family, so cant prove there is a rental agreement responsibility either.

    Can anyone offer some advice?

Don't include a letter of explanation. Save that for the interview. You don't have to prove "no intent" to adjust unless asked. Wait at least 30 days after arrival before you marry.

Do the paperwork and do it right the first time. Have someone with experience review your paperwork before submitting.

Thanks Ray B. The wedding was more than 60 days after arrival, so hopefully it should all be ok. I'm a little nervous as there is only 10 days until the entry stamp expires, so hopefully they will receive it and send through notification before the stamp expires! Thanks for the advice on the letter.
