  • DV Winner getting married a week before decision

I'm a DV lottery winner and am in my final stages, had my interview last week. I have received an RFE for my medical exam and have completed it yesterday, expecting my results on Monday. I also have an interview at the USCIS this week to submit my RFE.

Now, my partner and I have been intending to get married, but now this may happen in 2 days! Why? We received notice yesterday that her H1B transfer to her new employer was unsuccessful, so she will need to leave the US as she is now out of status. So now we need to move up our wedding date.

We are concerned as we feel there may be potential issues with this, and would like to ensure an approval for my DV case, assuming the rest of my interview and RFE is ok:

    1) During my interview, I said I was not married—which was true at the time—but now, after the interview and before submitting my RFE, this status can now change. What should I do?

    2) Is it possible for the USCIS to process my (future) wife's case as a derivative case of mine? Is there still time to do this prior to the September 30 deadline if we inform the office this week and have the AOS submitted to KCC before?

    3) If it is cutting it very close, what would the process be in terms of applying to sponsor her? I understand this can take up to 18-24 months, would this be the case?

I know this all is happening very suddenly, and its been pretty much a shock to us the past couple of days. What would your advice be for my case and hers at this stage? I really appreciate any advice at this point as it is urgent!

    Thank you
