  • i-751 complicated ex and current marriage

    Hi,

    I got married on 2009 to a doctor and genuinely fell in love. Our marriage ended after i found out he was cheating on me. This was not only based on my experience but also finding out he had cheated to a few women he wooed. (This was posted on-line. He was a real player). The process of my papers were handled by his lawyer up to a point of my case being in conditional status. After our separation, I had to work my papers on my own since his lawyer wouldn’t provide me assistance and i can't afford to get one. I tried to process my immigration papers by myself and I was able to get a year extension for my conditional status.
    During that period of time, i met a guy and same as the first one, he promised me the moon and the stars until i got pregnant and we got married. I'll admit on having poor choices on men. I am currently a nurse striving hard to support Everything: rent, food,bills and child. He DOESN’T want to get a job and i find myself grinding for this worthless relationship.I pity myself for finding it out the hard way. With a kid and working so hard,I wasn't able to keep track with my immigration status until I was notified that my case was moved to our field office ( I cannot pull out any information from UCSIS website) and therefore scheduled a meeting this Friday ( July 31,2015) at our field office. I am really clueless to what they would ask me or if my current marriage might affect my ongoing case.

    Shedding all my aces here:
    My current husband and I are going through a divorce (uncontested).
    I am currently working at a hospital knowingly my work authorization has expired last year ( I’m trying to make ends meet ).
    The only documents i can provide from my Ex-husband are photos, emails, gifts, letter and proof that he cheated on me.
    No joint account since he never let me touch his finances only an Amex card he provided me. ( I don't even have his SSN).
    I was sent this notification letter as of last May 2014 and only took action on it this week. (negligence due to pregnancy).



    These were all the same documents i sent to USCIS until they provided me that one year extension (exp June 2014).
    Would i need more evidence? since this is the only documents i can provide.
    Should i mention I am currently working?
    will they question my "current relationship"?
    will this void my ongoing case? (I-751)
    Are my chances to lift this conditional status slim?


    Please help me get an idea or a structured action that i myself can at least work on prior to this interview. My financial capacities are limited and a very knowledgeable information will be very very much appreciated.

    With what visa type did you originally enter the U.S.? If a fiancee visa (K1), your options might be limited.

    When did the one-year extension of our Conditional Status expire? Did you ask for an additional extension?

    Will your new husband go with you to your I-751 interview?

    Was the basis of your I-751 "divorce" or a failed relationship, with a waiver request by you?

      i came here as a tourist. I was formally introduced to this doctor and he petitioned me as spouse( relative visa).

      the conditional status was as of June 2013 and the year extension should have expired by June 2014 but no notice was provided for termination only an follow up notice again received last may 20,2014 declaring my case was moved to USCIS field office. During that period i was working and bearing a child in me. My current unfortunate "lazy" husband did not even do a follow up on my status. He was only depending on my salary. It really went past my head of processing my papers.

      and no, my current husband will not join me in my interview


      basis of i-751 was due to a failed marriage ( ended in divorce ) and requested a waiver since my ex-husband has re-married

        Most likely your Removal of Conditions interview will have a positive outcome, since you had made the application for a waiver with a solid basis.

        Your remarriage, however, might be held against you with the suspicion that remarriage was your intention all along. If there is a problem in your interview because of that "red flag," you will have other options for gaining Permanent Resident status.
