Is there anyway to leave the country for a few days whilst waiting for a green card?

  • Is there anyway to leave the country for a few days whilst waiting for a green card?

    Hi all,

    I've filled for adjustment of status after marrying my husband, I've had my biometrics appointment, then we got request for initial evidence (form I864, we forgot this,) which we've just sent off.
    As far as we understand, the next step would be work authorisation and then interviews and a medical before the green card is granted.
    We were quite naive to the timeline of things and have booked to go on a cruise to Mexico at the end of November - apparently if I leave the US it's considered an abandoning the visa petition. Does anyone know anyway to leave for just a few days, or will we just have to wait until the Green Card is granted (I'm pretty sure this won't be in time for November.)

    We sent off all our paperwork at the end of May and our case is in MO.

    I'm confused. You say you've applied for adjustment of status, but you haven't done yet your medical exam? That can't be - you submit your sealed medical exam results with the I485.

    If you don't have an advanced parole, or you don't have any other status - yes, leaving the US means abandoning your application.

      Thank you for the links! I think the best way to go is just wait and cancel our trip.

      We set the adjustment of status, request for work authorisation and petition for alien relative (my husband petitioning me.)

      I realised we may have missed a few things, including having the medical completed and to be sent with these forms, but when I rang USCIS to ask if we should get this done and sent with the I864 (just to speed things up so we wouldnt recieve another request for evidence,) i was told that I would be able to do this before the interview.

      Is this not the case usually?

        Hey,

        You even not sent the I864?
        i think uscis will send you a RFE (Request for Evidence) letter, and it will postpone your case until you reply their RFE Letter with the document that they ask.
        And its better if u cancel your trip.
