AOS on B2 visa overstay??

I got married to my husband while he was in the US on a B2 visa. We aren't going to be able to file the AOS for a few more months for financial reasons. If he overstays his visa, will it be an issue when we go to do the AOS paperwork?

Has anyone done this and been successful?
