Hello,
I wish someone could help me as i have spent a lot of money in attorneys and have not had any success.
My husband and me came to the USA in 2010. We filed an I 130 in 2010 which was approved however we had to wait for a visa to came available.
It finally came available in 2013 and we did all the paperwork and filled the I 485.
unfortunatly, it was denied by the officer during the interview as she stated that because of my husband being a permanent resident and me overstaying for more than i was allowed for the application had to be denied until my husband became a USA citizen.
He just became a USA citizen and now we need some advise but do not have money to spend in attorneys.
Should we filed a new I 130 in order to file the I 485? Should I go back to my original country in order to adjust the status or should pay a penalty?
