AOS From B2 Within US

  • AOS From B2 Within US

    My girlfriend came from the Philippines to visit her family out here. While she was out here visiting I popped the question. We are now going to get married in the U.S and would like to apply for an AOS. Before filing though I just want to make sure I have all the forums correct.

    So far I have these forms:



    I-485
    Form G-325A Biographic Data Sheet
    I-130
    I-693 Medical Examination Sheet ------ Do I need to know this prior to sending in the packet?
    I-864 Affidavit of Support ------- Is there a separate form for joint sponshership as my income is not high enough\
    I-765 (If She decides to work)


    Is there anything else I need in particular since she did come on a b2 visa?
    Also what are the cost for these forms?

    I know its 1070$ for the i-485 including the biometrics appointment.

    Add separate check for $420 for the I-130.

      We're in the same boat. My (now) wife came here on a B2 visa from Morocco to visit a friend and then I popped the question and we got married. The most important thing is that you file all this before her B2 Visa expires, otherwise she will be considered here illegally and then you'll find yourself facing a complicated mess that will likely require a lawyer's assistance. So find out when her B2 expires and be sure to submit everything before then by at least a week so they will have time to receive it. I just mailed our stuff two days ago and I'm waiting to hear back.

      Here's what I sent in my packet:

      - Cover letter describing contents of packet:
      Envelope 1 contains:
      - Check for $420 made payable to Department of Homeland Security for the amount of $420
      - Form G-1145, e-Notification of application/petition acceptance
      - Form I-130, petition for Alien relative
      - Two* Passport style photos of petitioner (myself) *they only asked for 1 but I sent two just in case.
      - Two passport style photos of Beneficiary (my wife)
      - Form G-325A, biographic information of petitioner
      - Form G-325A, biographic information of beneficiary
      - Copy of my naturalization certificate (or birth certificate if you were born a US citizen)
      - Copy of the biographical page on my non-expired US passport
      - Copy of marriage certificate (required)
      - Copy of marriage license (not required)
      - Copy of Religious Marriage Contract (not required)
      - Certified abstract of Marriage (not required)
      - certified translation of my wife's Moroccan divorce certificate from previous marriage.
      - Evidence of Bona fide marriage:
      - letter explaining our relationship history and marriage.
      - Affidafit of personal relationship letter written by friends, family, and acquaintances of ours stating that marriage is true (four of them)
      - selection of photos of us together on dates, of our wedding, on trips together....etc.

      Envelope 2 contains:
      - Check for $1070 for I-485 fee + biometrics
      - Form I-485, application to register permanent resident or adjust status
      - Two passport style photos of applicant (my wife)
      - Certified translated copy of her birth certificate
      - Copy of her B2 Visa page on her passport
      - Copy of the biographical page on her passport.
      - Form G-325A for applicant (my wife)
      - Form I-846 affidavit of support
      - IRS tax return transcript for 2014
      - Copy of my W2 for 2014
      - Copy of latest electronic paycheck to verify current income (not required)
      - I-693 Form, Medical exam, placed in an envelope sealed by by USCIS authorized Civil Surgeon
      - I-765, Application for for Employment Authorization.
      - Copy her B2 Visa page on passport.
      - Copy of biographical page on her passport
      - Two passport photos of her for I-765
