  • I-864 Changed from Initial Submission

    Hello,

I got a request for initial evidence asking me to submit latest tax returns. I now have the tax returns. However, I realized that when I was filling the I-864 the first time around, I didn't calculate my salary correctly. I calculated more than it actually is. I now got an official letter from HR stating my real salary and dates of my appointment. Can I send a new I-864 with the new numbers without getting in trouble? I don't want to look like I lied the first time around. Advice is much appreciated.

You can submit new income information, but you are "muddying the water" and might be asked to provide a new I-864.

My advise is to reply to the evidence request exactly as requested and provide only what is being asked for. If you submit the 2014 Federal income tax return, include copies of W2's and/or 1099-MISC or 1099-R forms. If you submit an IRS transcript, W2 or 1099 form copies won't be needed.
