Hello,
Please kindly advise on the following situation i am currently in.
My I-140 was approved a week back and I don't get married until February 2016 in India. By the time i & my spouse come back to the US it will be almost 8 months past my I-140 approval. Please advise if the gap is long enough for USCIS to question or raise any doubts on my AOS? FYI - my PD is current.
Can you please advise what can be other options? I am planning to goto India this October for a Biz visit - should we do a registry marriage in October and she file for H4 visa, come here and we file AOS together around November? We will have to goto India in February for our full marriage ceremony. Can we travel back to India while our AOS is in processing?
