I have following scenario :
1. My wife's and mine labor got approved from company A (we both used to work for same company) in 2002 and soon after
we both got laid off. Our company gave us 2 months time on H1-B visa to find another job and we both got jobs well in time
so remain on valid status.
2. After that I started for Company B while my wife joined company C. After 8 months with company B I was re-hired by my old company A for the same position/location/title with 9% pay hike as compare to pay on my labor cert.
So they ( company A ) filed my I-140 immediately which is now approved. I have opted for CP (Delhi).
3. My wife worked for company C for 6 months and then switched to her current company D (8 months now)
4. My wife is dependent on my GC (CP) processing and so we both will be going for CP interview.
I have following questions :
Q1. Can there be any issues with my CP interview because I left(though un-intentional) my company A (which filled my labor) and after 8 months (working for comp B) rejoined them ??
Q2. My wife's 2nd employer (comp C) has lost her original H1-B approval notice even though they have her original
receipt notice. And my wife has original H-1B approval notice from her current employer (Comp D).
Can this create any issues for us, even though she is 'dependent' in my GC processing ?
Q3. I have my passport valid till 2008 but the visa (stamped for company A) has expired in Jan'04, I have approved H1-B (I797) till 2006. My wife has similar case, her passport is valid till 2007 but the visa (stamped for company A) has expired in Aug'2003, she too have approved H1-B till 09/2004 and her
employer is filling her H-B extension which may not be approved by the time we have to go for CP interview.
Keeping all this in mind , can there by any issues at CP interview ?
Any suggestions/commnets are welcome .
