  • Request for Initial Evidence (I-485)

    Hello everyone,

My husband and I submitted his adjustment of status paperwork on August 7, 2015. He is from Turkey and has an F-1 Student Visa. We married on July 7, 2015. We received confirmation from USCIS that all of the paperwork was received, however, on September 1, 2015, we received a Request for Initial Evidence letter. One was for a new birth certificate from him (he did not obtain his birth certificate from the Turkish Consulate here in Boston so we know that's the issue) and the other was requesting tax documents from me.

My question is- do I need to submit a tax transcript from the IRS for the previous year, or can I submit a copy of my 1040 form? Right now the online tax transcript request on the IRS website is not working, and it will be 5-10 days to receive the transcript by mail, further delaying the processing of my husband's I-485.

    Thanks!

You should keep trying. Sending your form, is risking been rejected.
However, my advise to you, unless the time-frame would have passed, I would avoid the IRS Certified Copies and submit the Filed Form you have.
