Form i-864

Hello everyone!

I'm filing I-485 package along with form I-130. My Husband who is the petitioner for filing I-864 but he is not ellegibly because he still doesn't get paid, he's interning. We are a young marriage and Our parents pay for our living expenses. My question is, Can my relative(who is U.S citizen) be my joint sponor even if we don't live under the same household? Does it matter if her husband is on her tax report?

Also, a general question since all my documents are still under my maiden's name, is there any problem if I filled out all the forms with my married name even though my marriage certificate is under my maiden's name? I have seen people on this forum who had the same situation as me and had no problems. Please, advise.

Is there any chance I get I-765 accepted if I have b-2 visa, without filing I-485 form?

Form i-864

There is no problem if you file all I-130,I-485,I765 with your new married name because all lies on your marriage certificate, you need to file I-485 to be able to file I765 because you are already in the U.S. With legal entry, B2 visa but you will need a second sponsor to be able to file I864, you file an I -864 on your sponsor as the petitioner and another I864 with the name of the person as (the only sponsor) because your hubby don't earn money you need somebody who can reach the poverty guidelines.

Yes you can have the other person as joint sponsor even if he/she don't live in the same house as long as they meet the minimum amount to support the beneficiary and the household wife, just make sure to submit the tax transcript with the W2 or 1099 of the sponsor and you can use your married name in all the forms as long as you include a copy of your marriage certificate.
