Who is eligible to file 485 as per new visa bulletin
Hi Friends,
I am in a situation where I have I-140 approved in EB2 (it is NOT revoked) from my previous employer and PD is March 2011. Unfortunately I was laid off last year in January 2014. I joined another company and recently they filled my PERM in EB2 but it is still pending.
My question is as per Oct Visa Bulletin, can I file I-485 using my old I-140?
New visa bulletin changes are made as per President's executive action. As I understand President's executive action, anyone who already have PERM and I-140 approved and changed employer for any reason, they can still port they PERM and I-140 to new employer and file I-485 using old priority dates.
I am still trying to find out if I am eligible to file I-485 or not. Any help is grately appreciated.
