Hello and thank you for all the useful information here. My boyfriend wants to marry me in January and apply for change of status from visitor. I am a British citizen and he is a US citizen. I entered the US without a visa or I-94 as they are not required. If anyone can help me with answers to the following, it will be appreciated:
Due to illness he had to give up his practice as a social worker and has financial problems (including an arrangement with the IRS and bad credit rating). Will that affect his eligibility to file for me? We have a family member who is willing to do an affidavit of support as co-sponsor.
How long from the beginning of the process - filing form I-130, I-485, etc., - will it take for us to be interviewed?
Because he is unwell, he and I are living with a family member (my family) and so we share the same address. How important will it be for us to have joint bank statements, lease documents, etc? We have lots of cards, family photos, etc. and it won't be difficult to prove that we are genuinely together and adore each other.I want very badly to be with him and look after him but am worried that his health may complicate matters and make us ineligible. (His diagnosis is not terminal and he is expected to make a full recovery, after which we plan on going into practice together as I am also a social worker.)
