My mom was sponsored by her mom and her priority date is 20MAR2009, in the most current October the "cut off" is 15JAN08 for her chargeability BUT, under the B) charts which is B. DATES FOR FILING FAMILY-SPONSORED
VISA APPLICATIONS
The date is May2009. We got a welcome letter from NVC (ALS) now here's the deal.
We are all in the U.S. legally using different visas. My older sister and I are here on an F-1 and my mother is here on a TN visa. We understand that we can do AOS but I've read that it takes a considerably longer period of time but we will get EAD etc. only thing with that is that we don't really need an EAD we are studying and we'd rather wait a bit longer and get our full green card if we can just do CP. we are at the MTL embassy in Montreal if that matters
My questions are:
1) is my priority date current for CP (Consular processing?
2) how long are we looking at if CP is an option?
3) is AOS even an option? Based on our circumstances
4) cp or AOS?
There are 2 charts on VB one with a "final action" and another one. Our date is 20MAR2009 for F1 in India. Are we current as of now? Or are we only able to do AOS? I ask this because you said CP and AOS both require us to be current.
Side question: If I'm AOS will I be international at school? Can I take fafsa
