Hi all.
First off, I apologize, I know different versions of this question have been circulating for ages, but I can't find an answer that covers our situation. Thanks for taking the time to read this.
I am a USC through marriage, my spouse is a USC through birth.
I am petitioning on behalf of my parents (separate i130's and i485's concurrently).
I make very little money personally, less than $5k per year. My spouse makes more than $100k though. We have always filed taxes jointly.
I know that on the i 864, in Part 6, 19, a, b, and c, that they are looking for gross income, as found on line 22 of form 1040. My confusion lies in what to put on the i864 as the vast majority of that income was my spouses? Do I put the total for line 22 for each tax year as if it were my gross income or do I somehow separate my income from theirs and report only that?
In part 6 #2 I simply put $5k as my expected annual income. I'm self employed, should I include any evidence to support this? After all we are relying almost exclusively on my spouses income and are including plenty of evidence to support that.
I know that my spouse and I need to fill out an i864A, so the same question applies regarding Part 4, #'s 2a, 2b, and 2c. Does my spouse just put the total income from our joint tax return (line 22 on 1040) or put their individual gross income?
Thanks very much in advance!
