Cancel AOS based on wife and apply new AOS based on DV, would that be a problem?

  • Cancel AOS based on wife and apply new AOS based on DV, would that be a problem?

    I have AOS interview based on citizen wife in a week but I also won DV and my visa number is low and will be current Oct 1st, I have decided to appear on the interview and explain to the agent the situation and withdraw my application and submit a new one based on DV, is that possible? Is it going to be a problem with this process?

    This would be very suspicious. Why do you want to do that? If your marriage is legit you should pursue family based AOS. Abandoning makes it sound it was not.

      No we were in a relationship well over a year before our marriage and everything is good now (we're living together), but lately she is kind of bringing the idea that you're with me bcuz of your situation which is not true, I guess bcuz we are getting close to our interview she is stressed out, but now that I have a choice I don't want this green card issue to come between us. I know AOS officer might think it was a **** marriage but I have all kinds of documents to prove our marriage was in good faith.

        I can't counsel you for your marriage but she should understand the situation better. You can tell her you can do this without her with no problem but this is the proper way. She suggesting you are with her for GC is a bigger issue. 100% of real couples get approved.
