I485- but I130 is still pending at Uscis for the F2a applicant in US tourist visa

Hi All
my wife is in usa on visitor visa. She is flying back on 19th nov to india. She came here in the US in May. I saw the oct visa bulletin has 2 tables, can we use that table part 2 and apply for her AOS 485 along with EAD and AP papers? Please advise ASAP. Her PD is Dec 30th 2014 based on the oct bulletin we can file AOS for family categories having pd before march 2015

My case is similar to your case. I have been investigating for 2 days. So, I'd answer that we can do that. However, I don't know if my and your wife are able to stay inside the US legally while the I-485 is pending and after we get an approval I-485.

In our household, there are 3 of us: my wife who is the petitioner, her son and I the beneficiary.
Do we put 0 on item 3, part 5 (sponsor's household size) of the form I-864 to get 3 on item 8 ?

Yes U can adjust status of your wife, I have B2 visa I got married last year to my US citizen husband left the country and came back to visit on B2, I was going to apply from my country but my mother in law asked me to stay because my husband get depress when I'm not around cause he is bipolar, I'm aloud to stay until November 5 but once you file I-130 and I-485 concurrently the immigrant is aloud to stay, but can't leave the country until the AOS is approve, meaning getting the green card, but I suggest to apply for advance parole in case she wants to travel.
