DOB RFE I130 & I485 for parents - need help

  • DOB RFE I130 & I485 for parents - need help

    Hello all,
    I have filed AOS for my parents and got an RFE stating " submit a copy of DOB issued by appropriate civil authority for petitioner listed on form I-130. DOB cert must provide the parents names in order to properly establish the relationship between applicant and the petitioner" and it goes on saying if DOB is not avail then follow the sec evidence route. Here is what i have submitted with my original petition in place to DOB certificate (Not avail)
    **** Non availability (Showing my name and father's name , missing last names because it is old, petition has our last names, i submitted the same during my own GC application so did not want to send a new one with last names on it)
    **** 2 affidavits from relatives following the format that is needed

    I have asked for a new non avail certificate with last names included for my father and my mother but in India it is not a common practice to put mother's name on it. I am still waiting for what indian authorities will issue me. In the mean time i am collecting the following:
    1. DNA test - done and good to go
    2. Any old photographs of me with my parents
    3. Copy of OCI card showing full names of parents and myself
    4. Any academic certificate showing my name and parents name

    I am worried that i may not get anything useful from indian authorities as they are not cooperating and giving us unrealistic timeline without any promise of a useful document. i am worried that may get the same non avail certificate that i have submitted and it will be a waste of time. In the mean time i am preparing for the worst by collecting everything else i can. i need your suggestions that what else i can show to develop my relationship with my parents. my 87 days will end on Nov 9, 2015. Hope to see some suggestions.

    Jas,

    You are referencing "DOB" as the RFE basis. Do you mean "birth certificate" rather than "DOB?"

    If a government birth record is not available, you need to get something in writing from a government agency explaining why such a document is not available and obtain alternative documents (religious, medical, school) or affidavits to substitute for unavailable civil documents.

      Thanks Ray for replying back. Yes, what i meant to say was "Birth certificate". I have submitted "Non avail certificate for birth certificate" along with 2 affidavits along with an original 1983 statement from hospital certifying my DOB and parents name. Am i missing something else? Once again thanks for the reply.

        The "non avail certificate for birth certificate" should explain why an official birth cert is not available, i.e., fire, war, etc. Regular "cottage industries" have grown up in the Philippines for documents missing because of WW-II, and in Afghanistan because of documents unavailable because of war (or just because there are no such documents in Afghanistan).
