    First it says that I must submit my W-2 form my form I-864EZ (i forgot to include them), I already have them on hands and ready to send. Second one says " The petitioner/ sponsor on Form - 130 has submitted from I-864EZ... and however the income listed on federal Income tax return provided doesn't meet or exceed 125% of poverty guideline.
    Which is impossible for household of 2 and my income on W2 is over 80k. it says You must submit I-864 or get joint sponsor. What do i do? just send them W2 and some bank account statement to proof income and assets?

    I had the same issue with the I-864EZ and got a RFE and my wife made way over the income for three (3) persons. What I did after I just use the regular I-864 and submit all the documents again to include pay stubs and job letter. After I got the RFE what I understand about the I-864EZ is that they only use the income on the Tax Return and if the sponsor already sponsor somebody else, they cant use the I-864EZ. However if you meet the requirements for the I-864EZ such as:
    1.You are the person who filed or is filing Form I-130, Petition for Alien Relative, for a relative being sponsored;
    2. The relative you are sponsoring is the only person listed on Form I-130; and
    3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Internal
    Revenue Service (IRS) Form W-2s provided by your employers or former employers.

    You can go ahead and submit the W-2 and I would send back a new form also and remember to send back the letter they sent you.
    I would also but my A# on the top right hand corner of all evidence you submitting.


    NOTE **** NO LEGAL ADVICE JUST SHARING BASE ON PAST EXPERIENCE WITH THIS I-864EZ FORM.
