    So before sending the I485 and I130 for processing, what last name should my wife use on the paperwork? She will be taking my last name but, what document can we provide so that she can have the marriage last name on the green card? I am a US citizen

    Any help will be greatly appreciated.

    Legally after marriage my wife's last name became my last name. it was proved by the marriage certificate. She could have used that anywhere. They said go to Social Security Administration and DMV to get new driver license and SS card. Since she did not have any of them prior so we did not go those offices back then but it was perfectly acceptable.

    Then we filed all the AOS paperwork with married name and provided the marriage certificate and original birth certificate of her. Biometrics was no problem with marriage certifcate and maiden name passport. Then EAD card came so that was first official ID we had for her with the new married name. Then she got her SSN with that name. And recently she got her GC. Now we will go to DMV and get her a driver license/ID card with the her legal name. which is her married name.

    The marriage certificate we have is legally changing spouses names. It might be state dependent but I doubt it. Also there was an opposite experience on the forum recently. During biometrics they were not happy. so this might not go as smooth as it did for us. But legally if her name is changed, she should use that everywhere IMO. You would want your wife to have her married name on GC.

      If she wants to have your last name & you're married you don't need to prove anything.

      Example:

      Petitioner is: John Doe
      Beneficiary is: Mary Smith

      Fill out all the documents as Mary Doe. Those forms will have a section where it says "Other Names Used (including maiden name)" & thats where you would right Mary Smith.

          I do not think you can put it without a legal name change document. Marriage certificate is one of them. If you did not request that change you can't do at will...

            For whatever reason we had a small hiccup when we went to our biometric appointment. The representative made us drive all the way home to get our marriage certificate to prove our marriage because my wifes passport had her previous name, and we filed everything in our new married name. The rep told us we should have filed using her original name, and do the name change after. However, it seems to me that we were still able to move forward with processing.

            I think they will just want some proof documentation of the new name when you go for your appointments, so always remember to have that handy as she obviously has no other identification with the new name.
