Below is our case details and questions.
I was working on F1 OPT married to LPR.
- OPT expired July 18, 2015 (On maternity leave since May 2015, did not return to work due to expired OPT)
- applied for I130 as "LPR spouse" in early June 2015 (before OPT expired)
- husbands oath ceremony is late oct 2015
Questions
- how do we upgrade our 130 application to "USC spouse"? Do we just fill out 485 and mail (along with rest of docs like medical. Fee, etc)
- what do I answer for part 2 (I am applying to adjust because) in 485 form?
- can we also apply for EAD and AP along with 485? Do we just fill out the forms and mail along with 485?
- since I am past 60 days of OPT expiry, is my case complicated?
