  • Request for Initial Evidence (I-485) - - - PLEASE HELP!!!

    At the beginning of October, I filed Forms I-485 and I-765 for my step-son (unmarried son under the age of 21), which was accepted on 10/6/15 and an appointment for his bio-metrics was set and completed on 10/28/15.

    Then last week I received a "Request for Initial Evidence" in the mail requesting additional information:

    1) evidence of petitioner/sponsor current income,
    2) supporting tax documentation for most recent tax year and
    3) based on the documents submitted with Form I-864 the income did not meet 125% above poverty guideline requirement - submit evidence of assets that meet the standards and/or obtain a joint sponsor.

    For 1) I have all the evidence (letter of employment, past 6 months of pay stubs and 12 months of bank statements) and for 2) I have all the support tax documentation but for 3) I do not have the evidence of assets (I have none) - - - however, I know I am receiving this request due to the fact that I made a mistake under Part 6 of the original Form I-864 submitted in October! Upon review of the form again I found that my current individual and household income did not meet the 125% above poverty guideline requirement and I also did not provide any "current income" evidence. So given these two (2) mistakes and the fact that my income shown on my most recent tax return from 2014 also did not meet the requirement I know this was the reason for the request.

    So since my current income does meet the requirement and I can prove it.......I am left with one main question to be answered before sending everything to them.........."Can I (and should I) file an Amended I-864 Form" given the fact that my original form was incorrect and the evidence I am providing them now will not match the original form?

    Also, since I can now prove that my current income does meet the requirement, do I still need to submit evidence of assets??? I believe the answer is NO but since they request said and I quote "Submit ALL of the information requested below at one time. Failure to do so will result in denial." I am nervous not to provide it so I printed all my bank statements to provide but do not have any other asset information to provide, unfortunately, and I also do not nor do I need a joint sponsor since I meet the current income requirement now.

    Confusing but not! I feel I should just send a Amended I-864 along with my current income evidence and support tax documentation for the most recent tax year and will be good but any advise is much appreciated! THANK YOU!!!!!!!!
