    Hey guys,

    I'm Anca, i'm romanian, i live in United Arab Emirates for more than 4 years,(here i also work like a cabin crew) where i have met my husband.
    This year in April he received his green card through his family(mom, dad, sister), so he is permanent resident so he left to US( New York)
    In August, we got married in New Jersey and we visited couple of lawyers but we cannot find the best solution for us to be together faster, not 3 years like the lawyers are saying.

    I've done some research and i would like to ask you few questions please if you can help.I also have to mention i have crew visa and tourist visa valid.I've checked and both lawyers told us that till i-130 will be approved i can visit him as much as i want, plus i can see him when i'm flying there with my job.

    1. If he applies for me the i-130 while i'm still in UAE, after my file is approved, can i go there before my visa adjustment and stay there with him until my visa number becomes valid?
    2.If yes to no 1, can i also apply for an employment card while i'm waiting for my interview to have the possibility to work?
    3.What happens after my i-130 is approved? Can i enter usa with tourist visa, do you think it will be easier, because i will have to resign my job here and maybe the immigration officer will see that i have no where to return. Can they cancel my B1 visa?

    I also have to mention that my husband he is looking for a job now, he doesn't work in this moment, but he will work very soon.

    How do you guys advice me is the best thing to do to avoid waiting these 3 years of waiting?Or i don't know how many years we have to wait.

    A two-three year waiting period is standard for spouse of a Green Card holder.

    Your husband should proceed with submitting an I-130 for you.

    You have no legal right to work in the U.S. while waiting for your spousal visa status.

    Given the above, it makes no sense to pay an immigration attorney $1,000 - $2,000 to complete and submit an I-130 which will only result in your having to wait 2-3 years for a visa slot. All your I-130 package needs is proof of your husband's Green Card status, both of your birth certificates, marriage certificate, G-325A for each, and proof of relationship.

      After my i-130 is approved can i go to usa and stay there and apply from there for adjustment?Even if i won't work?My tourist visa allows me to stay 6 months, exit and again 6 months!
      And do you know if he will apply for adjustment, i can still visit him?Till my answer is ready?

        Since your husband will only have Green Card status, your Adustment package won't be accepted since no Priority Date is available for you.

        Once your Priority Date is reachable, and if you are able to use your B2 visa to come to the U.S., you should then be able to do an Adjustment of Status

          So 1st step we will apply for i-130, after i-130 will be approved we'll apply for 485 form,right?And when i should find out when a no of visa will be avlb for me?Do u have idea how long it takes?

              Filling the i-130

              Hi guys,

              When we will fill the petition i-130, there is at the paragraph C, no 22 "complete the info below if your relative is in the US and will apply for adjustment of status",

              My husband is in usa and he will apply this form for ne these days, i currently live and work in another country, after the i-130 will be approved i'm planning to go to usa with tourist visa, because i have this visa for 10 years and there to adjust my visa status!

              Can i do that if i don't live for the moment in usa?Or usa they will send the file to the embassy from my country? thank you!
