I came to the US back in 2001 with an "I-20". I got married with a US citizen in 2013 to adjust my status. We had our interview back in Nov 2014. After our interview, i was asked why i have not left the country after finishing the school. I never attended to school, though. Then we have noticed that the visa I have been mistakenly given back in 2001 was actually a J1 visa, not an F1 student visa, which reuires the bearer to leave the country for at least 2 years (known as 2 year foreign residency requirement for J1 visa holders) after the completion of the education. Now, uscis requires me to provide a reason for not leaving the country or a waiver filed for this requirement. My visa was suppose to be an F1 which my I-94 form already has a hand writng on it with "F" but not sufficient. For that reason, we asked to get the proper information from the school but they did not have any record on my name since I did not attend to school. So We Tried to ask this information from the US embassy for additional info about my visa application that I made back in 2001 but they said the records are too old to be retrieved. We now asked USCIS to check their records, hopefully they have the information in their archives. We havent received a reply yet. (It has been 2 weeks by the way as of Nov 6, 2015) Long story short, i have been waiting for my pending case to be approved evenhough I have been married for 2 years. I am stuck because of an error that the US consulate(Ankara/Turkey) made years ago. Any advice or opinion is greatly appreciated

Get your J1 waiver and stop looking for loopholes.
