  • Marriage on Visa Waiver Advice

    Just a quick question. I am traveling to the US in 10 days with my US born fiance who has been staying with me in the UK the last 5 months. It is a planned 3 week trip.
    Both of us are not wanting to have any time apart and I have read about getting married on my visa waiver and applying for a change of status for permanent stay. For this to be approved obviously I need to make it clear that it was not my intent to get married or apply for my change of status until I was already in the US.
    I have a full time job, bank account etc in the UK which I would have been coming back to after the 3 weeks, this includes an official letter from my office detailing my time I booked off and when I am due back.
    Would this be enough evidence to convince the immigration that my intention was not to commit visa fraud? Any help would be greatly appreciated.

    If you have the visa waiver already, it is just asking for trouble if you indicate that you are travelling to the U.S. with your U.S. citizen fiancee.

    At that point, to allow you to enter the U.S. becomes a discretionary decision on part of immigration officer.

      Do you think it would be best for her to not wear her ring, our engagement hasn't exactly been announced. The immigration officer would have no reason to deny entry to a guy visiting the girlfriends parents with a job to return too, right?

        It probably doesn't make much difference, anyway. If from a third-world country, use of a visitor visa or visa waiver status when travelling to the U.S. with a fiancee (or wife) is often interpreted as an "intent to immigrant by circumventing normal immigrant visa requirements." But there may be a different attitude if from U.K. and other Western Europe countries. One's age hs a lot to do with potential denials, also.

          Marriage application

          Hello people,

          I am an Australian citizen. I am married to U.S citizen. I entered U.S.A TX October 11 2015. We submitted our application on October 16 2015, Approved by USCIS on October 23rd 2015. I would like to ask if there is any other way to speed up the process of getting EAD card. I have never been out of job for this long in my life. And I hate staying at home and not being able to do anything.

          I have my biometric appointment November 19th 2015. How long does it take to receive EAD card? Is it possible to receive EAD card before biometric appointment?
