  • Request for Initial Evidence (I-485)

    Background Information:

I am the petitioner, and I am applying for my wife. We have received an RIF with the following request:

Form I-864, Affidavit of Support, was submitted; however, Page 3, Part 4 of the petitioner/sponsor's Form 1-864 list someone other than the petitioner/sponsor or Page 3, Part 4 is blank.
Form I-864 Affidavit of Support was submitted from a joint sponsor; however the names listed on Page 1 and Page 3 are not the same.

We filled out the I-864 form the following way:

Page 1 Part 1 - My First Name, My Middle Name, My Last Name
Page 1 Part 1a - This box was checked - I am the petitioner. I filed or am filing for the immigration of my relative.
Page 3 Part 4 - 1a. My Last Name 1b. My First Name 1c. My Middle Name

I am the only sponsor, there are no other joint sponsors as my income is enough to cover the minimum requirements.

I am not understanding what is wrong with the application. The only thing I can think of is the order that I wrote my name in the Page 1 Part 1 (not in the same order as Page 3 Part 4) however we followed an online example for this. Has anyone ever seen this issue before?

Should we re-send the application again with the name in Part 1 as Last Name, First Name, Middle Name? Do we still need to send new copies of the W-2s, 1099, etc? - Some of these documents we need to request from the IRS and it will take 1-2 weeks to receive!

Thank you in advance for your reply!

Something was wrong with the way you completed your I-864. Do it over and have an experienced person review with a second set of eyes. You should resubmit a complete package, with copies of W2's 2014 tax return, or IRS transcript. Didn't you keep a copy of these documents from your first submittal?

In fairness to your frustration, the I-864 causes lots of problems because each version (recently revised) becomes more cumbersome and confusing. The last version was 9 pages, and the recently revised version is 12 pages, and the changes are out of sync and guaranteed to confuse anyone. The first page, though changed somewhat, also causes problems since anyone used to the older version is likely to have some confusion adjusting the new version.

      Thank you for your response!

I have also attached the document that we filled out, with names, numbers, etc changed. The only other problem that I can think of may be the "In care of" section where we put N/A.

If somebody can take a look with a fresh pair of eyes at the document I attached. Currently what we are planning to do is to send the same form, however to add to the additional information section noting that there are no joint sponsors and that the petitioner is the sole sponsor.

I do have some copies of the documents I already sent in, but for the IRS transcript I just took some pictures with my phone.

The completed document with our personal information changed can be found here: https://www.scribd.com/doc/289954632...hb04C2RN8jqPU0

      Thanks,
      D

Your recreation of your originally-submitted form looks fine to me. The only explanation I can offer is that your original form had something out of sync.

RFE for I-485 (pls help on prioriyt)

          Hi,

We got an Initial RFE for dependent in I-485 step.
Provide proof of H4 status maintained from Jan 2012-Oct2014.
          a) H4 i-797 copy
          b)I-94 info

H4 /Spouse came to US from India (first time) after H4 was stamped( in consulate Jan2014).
          Question is :
          1. How will H4/Spouse get a i-797 when came to US( for first time) In Feb2012 ? Was there a way to get it after arriving to US after few months?
          2. How to get a copy of I-94(arrival) when initially entered to US in Feb 2012 ?
On cbp.dhs.gov/(US Border Dept site) only the most recent I-94 shows up and not for Feb 2012 ? (Also shows travel history of 5yrs).

Pls reply with details on 1 & 2 (little priority) , Will greatly appreciate.

          Thanks.
