Hello Friends,
I've a very tricky situation with my H1B & GC. My H1B is due to expire mid May 2016 (all vacation recouped) and my employer will file PERM only by 1st week of January. So what this means is that my I140 may not be approved by the time my H1B expires. Below are my options, please suggest the best one :
1) Take 2 months vacation in February and come back by early April. Come back and file for I129 extension for two months. So this will help me to extend visa for 2 months, but does not guarantee that the I140 will be approved by this time.
2) Stay here till the end of tenure and go back by May. Comeback to US, when the I140 gets approved.
3) I was told by the company attorney that there is an option to change to F1 for a short tenure with part time job. If this works out, I can change the status to H1 once the I140 is approved. But I dont have the details of this and the company attorney dont work with this. Can anyone shed more light on this, if you have any experience with this ?
Also any other thaoughts/options that you guys think will also be much appreciated
