  • I-485 (work based) approved but reopened...

    Hi,
    here is my story:

I filed for GC 2 years ago and everything went normal: finger print one month after filing, got EAD 3 months later. than things were quite for couple of months.
in August this year, the status went to approved, and I received a welcome notice .
shortly after, the Green card is issued and shortly after the status is "the GC was sent" and the tracking number was given.

I tracked the letter and it came to my post office and the status went to "out for Delivery" so I was expecting it to come same day...I was excited

    it didn't come!!

I waited for another day and a third day, the tracking status became "Delivered"; I went to PO, they said that the tracking is showing the letter as "Delivered" so they can do nothing.
In myUSCIS, the status is set to "GC Delivered" with same detail as PO! but I didn't know where it is!
I went to all my neighbors home (here are many), one by one to check if the Post Man delivered it to the wrong address, but didn't find it.
I was going to the PO almost in a daily basis and this for a month hoping some one would bring it! but nothing appeared in a month or so.

until September (a month after delivered status): the status in myUSCIS changed to "we received your GC and it wasn't delivered because of a wrong address"!!
I went to the PO, and in fact they never delivered the letter, it was sent (by the Post man) to another post office!
I tried to understand why, and found the issue: I live in the border of two towns (say A and B), I live actually in Town A, but my PO is in town B, whatever I put as town, the letters were delivered and this for years as long as the Zip Code is good , the letters always come home (all notices from USCIS, all letters...).
but wondered why only the Green Card was not delivered? I had many discussions with Post Office (they know me well by now) and what happened is that in august the Postman that knows well our neighborhood was off for vacations and replaced temporarily by another guy, who unfortunately doesn't know us and assumed that the letter should go to a PO in Town A and not in own B he just decided to not deliver the letter at all and send it to another PO with a mention "wrong address", there the PO just sent it back to USCIS.

The story is not finished yet, I just requested from USCIS to send it back, and they sent me a notice that they will send it back and that I should get it by November 10th!
but nothing came in November and I went to check the status and it was "On November 2, 2015, we reopened your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt
Number XX, and mailed you a notice." in the notice received, nothing was indicated, almost same message with a mention that "after review, we have reopened the above application or petition, or reconsidered the decision previously issued. You will receive a notice under separate cover once all action has been completed".

No news after as of now...

Can you please help me understand what happened? what would the USCIS reopen the case? do they suspect that I live in the address I gave? I am the owner of my home and live here with three children born in USA! I am not sure of my status now, can I work? should I apply for EAD renewal? it will not be ready before next year...

    I appreciate your help!

Seems like, they will reject your petition assuming you abandoned GC. You should open an SR and let them know about non-delivery from post office. get a letter from post office saying it was not a case of wrong address. Be pro-active and furnish the proof to USCIS that you did not recieve the card even though your address was correct.
