30/60 day rule for AOS (F1 to GC)

  • 30/60 day rule for AOS (F1 to GC)

    I currently hold an F-1 visa (granted in June 2014) and study at Northwestern University.
    I will be coming back to the US from a trip to Canada on January 2nd. My F-1 is valid until June 2016 and I will continue my studies until graduation in June 2016.

    My partner (USC) and I have been together for 6 years (before moving to the US) are planning on getting married on January 5th and filing for AOS the following day.

    Should I be worried about change of intent? Do I need to wait 60 days from my last entry on F-1 before applying for AOS? Or am I covered by the exception for "immediate relatives"?

    there is no given timeline, but the lawyers usually suggest you wait 60 days. most people including me waited 30days. i would suggest wait 30days, and file in feb!
