Hello, my husband received his EAD combo/AP card. We got married in May, and his tourist visa expired in July, however we didn't file till September. Can he travel abroad even though he overstayed his tourist visa? We want to go abroad to celebrate our birthdays! Thank you.

He is currently in protected status as your application is processing, however just because he has Advanced Parole doesnt necessarily mean he has the right to return back to the United States from foreign travel. If he did not accrue 180 days of illegal presence he might be OK. Still people advise not to leave the country if you were out of status.Comment
