  • How long should I wait to submit an AOS?

    Hi
    I have been in the US since October and in that time I have made 3 short trips out of the country to see my wife's relatives. The last time was in late November.
    Should I not look to submit any firms until 2 months have passed from my latest entry or take it from the time I first arrived. The trios out have only been for the weekend.
    Any guidance would be really helpful as I would not want to fail at the first hurdle.

    Any members have a thought on this one

    With the holidays coming up I'm having to decide whether I go out of the country again or just stay. It dies make it difficult considering families are getting together for the holidays. I don't want to leave and then find out the clock starts ticking again from zero.
    I will have been here 3 months by the end of the year and need to decide whether or not to AS or not. Some people may have applied as soon as they landed in the country but that looks a little suspicious. My intention was to stay fir the duration of my visa but increasingly it looks like that won't be enough time so we as a family are still debating on whether we stay here much longer than anticipated.
    I'd appreciate your views on timescale

          Your Q is not clear. Which status do you have? Are you married to a US Citizen?
          At the entry what was your purpose? What did you say to the officer? When did you get married?

            Apologies for not being clear.
            My status is as a B2 tourist visa holder. I have been married to a US citizen for over 10 years. I came here to be with my wife and child as due to family circumstance they returned to the USA. my intention was to be here for 6 months which is what I told the officer. (Original stamp in passport is for 6 months and the latest I94 record has a date in May.) The time really was to be with my child and wife whilst I had the opportunity so not really travelling around all that much (although we have done some). I mentioned it at the embassy when I applied for the visa too who didn't think it was an issue to stay in one place.

            Increasingly it does not look like my wife can move back with me so the thought is I stay here alongside her. We would then set up our future here instead. No decision could be taken as family illness is a main cause for her return to the US and it has had a bearing on where we end up living.

            My question is how long should I leave it before applying for AOS if I left the country for the weekend?

                        It's quite obvious

                        That not a single senior member is willing to answer my query for whatever reason, I was not clear enough, polite enough etc. The courteous thing to do would be to at least acknowledge the question and state it is not possible to answer the question.
                        I'm not entirely sure if thus forum is run on a voluntary basis or whether regular (senior) contributors are remunerated for their efforts.
                        I will struggle on regardless and will most likely post my experiences for others who may find themselves in a similar situation so that it at least a helps someone else.

                          I wish I could really understand your question. Are you married to a US citizen? Are you out of saris already?

                            Ok to put it simply

                            I have been married to a US citizen for over 10 years but lived overseas all that time. Last time I entered the country was in December 2015 under a B2 visa. The intention was for me to return to the UK end if March but we have decided it maybe best we stay here in the USA. Obviously a big change in plans than original idea of leaving.

                            How long should I wait to make an AOS application. Will it look odd that I am immediately applying for AOS since my last entry which was in late December. Bear in mind I have actually been in here since October 2015 and the trips out of the country have only been for the weekend at any one time.

                            My latest I94 record shows a date if 8th May 2016 by which time I have to leave.

                            I don't know what saris is by the way.

                              I believe you can submit it now. It shouldn't be a problem; however, you can't leave without being paroled before an approval. If not you application will be terminated. Hope this was helpful.😆😆
