  • Help with criminal record

I just got married to an American Citizen here in the US. I'm currently in my tourist visa and we're trying to put together and submit all together: Form I-130( petition from my husband as an immediate relative), Form I-485 ( adjustment of Status), Form I-765 ( Employment Authorization), And Form I-864 (Affidavit of Support). For the Form I-485 one of the requirements is Criminal History. My question is , Do I still need to get a NBI clearance ( Criminal History) from where i was born and send it together with the form even though i haven't committed any crime?
    Thank You in Advance

If being processed in the U.S., you are not required to submit police clearances from abroad (unless specifically told during processing or at interview).

      Urgent

      Ray B and others,
I had my biometrics today dec 31st, 2015. However, when I got home and checked my case status, I discovered a message had been sent initial rfe on dec 29th. What does this mean?

Nobody can tell you what the RFE is for until you get the followup hardcopy correspondnence detailing the error and what you must send to remedy the error.

Thanks for the prompt response. I shall update you when I receive the hard copy of the correspondence in the mail.

I got the rfe letter today

            Ray B,
I got the letter for RFE in the mail today! They required evidence of petitioner/sponsor current income. They said it should include the following:
            Start date
            Hourly rate
            Nature of job
            Number of hours per week
            And yearly salary earned
            6 months pay stubs
            Prospect for promotion.
My wife says she would go talk to HR dept at her workplace tomorrow to get an employment letter detailing all these. Is this the right thing to do? Because the employment letter we submitted earlier only included start date and hourly rate.
            Thanks!

To satisfy this evidence request, your wife should try to provide evidence that each of the points specified are responded to with some new evidence.

My stuff got the letter from her work... However, the heading of the letter refers to our last name together, while the body of the letter contains her last name with her ex that she still uses in correspondence at her workplace. Even her pay stubs carry her former last name. We already submitted proof of divorce in the application so I believe that will show that was her last name in her previous marriage. What do you think?

Get a new employment letter to satisfy the letter of the request.

                      Rayb,
My work wife got an employment letter stating everything USCIS demanded, including 6 months' pay stubs. We mailed and they received it- according to the update on my case status on their site- the next day on January 14th. Any idea on timeframe as regards when I can I expect my EAD and update concerning interview?

Correct responses to RFE requests usually result in continued processing, the EAD showing up in about 3 months plus RFE delay time.

                          Rayb,

My EAD was approved two days ago on the 27th. Do I still have to go to social security's office considering the fact that I already got SSN while in school on my F1 visa? Also, how soon should I expect to be notified of my interview date?

                          Thank you.

There is no reason to go back to the SSA office, unless your SSN card has an annotation on it to be removed ("Valid only with DHS authorisation") or something like that.

                              Rayb,
It does have that annotation ( "Valid only with DHS authorisation") on it. So how will I proceed after getting my card?

                              Thanks!
