Hi All,
I'm currently in a situation where I don't know what to do as I've heard different things from different lawyers.
So my story is that I've overstayed my visa by about 16 years (I was brought here by my parents) and I married a LPR and I have an approved I-130 petition. Now we've spoken to several lawyers and some lawyers suggest that I can adjust my status despite overstaying my visa and my husband being a non-citizen (citizenship papers are filed and currently in process). While others suggest that I wait until my husband becomes a citizen and then file my I-485 adjustment of status.
I'm a little confused on what should be my next step, I obviously want to obtain my papers as soon as possible, but not sure if I can adjust my status. I would appreciate it if someone can share their experience.
Thanks.
