  • I-485 affidavit of support question

    I just got married to an American Citizen here in the US. I'm currently in my tourist visa and we're trying to put together and submit all together: Form I-130( petition from my husband as an immediate relative), Form I-485 ( adjustment of Status), Form I-765 ( Employment Authorization), And Form I-864 (Affidavit of Support). My husband does not currently work does he still have to fill out the I-864; his mother, my mother in law will be the one doing the affidavit of support since he doesn't work. In the I-864 we put that she is the only joint sponsor.
    When i read the instruction for the I-485 it is confusing; do i need my mother in law to fill out the i-130 also? or just my husband

    Your husband is the primary sponsor, even without any income, so he needs to provide his own I-864.

    Mom can provide a second I-864, or, if living at same address, she can be a household member co-sponsor, have her income included on hubby's I-864, and provide a separate I-864A.

    Mom does not submit a separate I-130.

      my husband is on part 5 household size of the i864 and he entered me as 1 in the "persons you are sponsoring" since i am his wife does he put me as 1 also on the number 3 if so it would double or does he put 0 then? cause it says if you are married add 1.

        If the spouse is the immigrant, the spousal box is not checked and not double-counted.

          got another question
          my mother in law has her taxes done with my father in law should i also have my father in law fill out a separate i864a. My mother in law is already above the guideline but they have filed their taxes together, if i do have my father in law fill out the form can i just submit one copy of their taxes or 2 copies of their taxes cause its the same with both their names
