My 140 has been approved, my 485 EAD has been approved. My J visa will be ended in one month. My new employer is willing to petition H1B for me. I learned that H1b petition takes time. I might face with 1-2 month gap of unemployment status before getting H1B approved. Questions are:
(1)Can I petition H1B while EB1A 485 pending and there is 1-2 month gap between the two jobs?
(2)Or should I use the EAD instead and wait for the 485 get approved?
(3)If I use H1B and have an unemployed gap during H1B petition, could this unemployment status affect the green card process (e.g., 485 RFE for EVL)?
(4)If there is a 485 RFE for EVL in this unemployed gap during H1B petition, could I provide the new position offer letter as an EVL, and waiting for H1B approval?
