  • Request for Initial Evidence(I-864)

    Hi everyone,
Today, I got a request for initial evidence in the mail. This is the content of the letter:

Form I-864, affidavit of support was submitted, however, it was not from the petitioned/sponsor.
    - Submit a completed and signed Form I-864, (Revision date of 07/02/2015), for the petitioner/sponsor listed on form I-130........ Also provide copies of the petitioner/sponsor's most recent Federal income tax return and all supporting tax documents.

Basically, when I was filing my I-485 (adjustment of status), I-130 (Petition for alien relative) and I-765 (Work permit), I had my brother fill out I-864 because we decided he is going to be my sponsor in this case (Wife, who is a US citizen, cannot sponsor me financially). My brother provided I-864 filled out and signed with supporting documents.

My question is, what have I done wrong? Should we have filled out the I-864 any differently since my brother is going to be the sponsor in this case?

    Thank you,

    Request for Initial Evidence

Your wife also need to fill (I-864) and submit with the application. Your brother will be the sponsor.

So my wife needs to fill out another I-864 and submit with the supporting documents? My brother does not have to resubmit since we already sent his I-864?

      Thank you,

        Thank you,
You don't need to send the same document twice. Just send what ever else is requested. The wife will fill out I-864A not I-864.

Yea you see. This is what gets me confused. I don't know what difference between the 2. Also, in the Request For Initial Evidence, it says I-864 and not I-864A.

Can you please show me in details what I should have submitted initially?

I am married to a US citizen, my brother is going to be my sponsor.

          Thank you,

            Affidavit of Support

When you were sending in you forms you should have send in a completed I-864 by the petitioner (the person filing for you). However, if the petitioner does not meet the required threshold income level then you will have to get another person who is financially stable to be your sponsor. They will also have to give you their most recent Federal income tax return and all supporting tax documents, W2s, letter from their company stating: how long their work at the company, their position, salary, hourly wage and also a copy of their green card or citizenship. I have first hand knowledge because I just went through the same process.
