  • missed the "request for evidence" letter

    i just found out they sent me a letter to request for more evidence in June 2005 a couple of days ago. now what shall i do?

    Please allow 14 days for delivery. If you have moved during your case pending period, and did not inform USCIS, you need to call them immediately.

      i have already missed the letter whcih was sent to me 8 month ago.

      i have called them recently, and the operatior told me it's not a very serious mistake, the officer might send me another letter if needed. and he would send the officer an email about it

      can i trust what the operator told me?

        Do you have an attorney? It is a tough one when you have to take someone's word over the phone. Were you able to get any details on the person's name? the operator who told you they would email the officer? Did they ask you to wait? any time frame given? you may want to do what i have indicated below to see if any updates are there- if you haven't already see (**) below.

        Maybe further research online for similar experiences is the first step. To determine next step. Go with key words like what you have typed in the subject box for this posting... it may pull up some similar expiriences....

        If that fails and you feel anxious... I would seek the advice of an attorney if I did not have one. At least to advice you on the best way to go about getting this letter for the RFE and also what you should expect, given that now it is more like you didn't respond and the "mistake" maybe on your part? It is always easier to deal with any complications via an attorney (This is simply my opinion from my past expirience).

        Did you move and did you report a change of address ASAP? What other reasons are there?

        This is where you can enter you case number and get an update on the status of the case. I have found it very usefull as they actually do send out emails to update you whenever there is any activity on your case. And they will updated the case status page with what action they are taking or have taken. I suggest you register since there maybe some more information on your case. Per your conversation with the phone operator ( you may have already done so).

          thanks for the reply, i have done everything in your post. the attorney told me to send out a polite short letter to explain. hope the officer sees my letter.

          is there anyone who has made the same mistake?
