My son in law came here on a fiance visa. They were married within the 90 days and filed for I-485 right after. Last year 2015 in March he had his interview in Portland Oregon for the adjustment of status, as he already had received his EAD. During the interview he and his wife were told everything was great and he should receive his perm resident card within 90 days. After approximately 5 months waiting they kept calling to check on status and was told to wait until the processing times passed. Finally in October they spoke with someone who told them it had not been processed yet because they still could not find his file, apparently they didn't have the file on hand when he went in for the interview either. In November they went to the Portland office and spoke to a person there who stated they still could not find his file, but he promised he would be on it and get it processed. They explained that his EAD had alreay expired as well as his drivers license and he needed something to show he was here legally. They told him they could not do anything until they could find his file. It has now been a year since his actual interview and they still can not find his file and he has not been able to get any help. He filed a grievance with the ombudsmans office to investigate but is still waiting on it. Meanwhile, he can not work, drive and to top it off the rental place is giving them 60 days to bring in an unexpired ID or they have to move out. He asked for an extension on the EAD at the local office but they would not do it without his file. Can anyone recommend what to do to get some type of help without having to hire a lawyer? His wife is due with their 2nd child in April and he will be loosing their health insurance from work if he can not provide work permit status by the end of this month. Someone please help, any suggestions would be greatly appreciated.
